On Harriet Miers' Nomination: Again
A new website on (against) the nomination of Harriet Miers has the transcript of the conference call Republican National Committee / White House held with key Republican decision makers in support of her nomination. The call took place on Thursday. Among the speakers was James Dobson who, having discussed the nomination, according to his account, four times with Chuck Colson, has changed his mind and now favors Miers confirmation. These remarks of Dobson struck my eye.
Everything I care about is on the line because the court has usurped the other two branches of government and has made all great social decisions, answered them or tried to answer them for the American people, and taken away from the people the responsibilities that Abraham Lincoln talked about in the Gettysburg address, he, he said this is a government of the people, by the people and for the people. And it has not been that on all of the great social, moral issues. And because the seat that's being vacated by justice O'Connor has been a swing vote, this decision is of earthshaking importance in my view and that's why I've taken it very seriously, and why I have maybe drawn the conclusion that I have.The second disclaimer that I want to say is that I'm speaking only for myself, not trying to argue with anybody or sway anybody. I've got close friends who are mad at me because of the way I see this, but I think each, each of us has to do that. But I have drawn the conclusion that Harriet Miers will be an excellent justice on the United States Supreme Court. I, I'm not absolutely positive of that cause you can't know till they get in power and then it's too late, and power itself tends to corrupt, and it has happened with some of the other members of the court in my view and it could happen to her.
My first comment is that almost every word in the entire transcript would grow grass in any county. Dobson's remarks are a class of fertilizer onto themselves. Exactly what responsibilities has the Court taken away from the people other than the responsibility to defend the Constitution? No, Dobson is against a women's right to choose and he just doesn't care that a majority of Americans support t Roe v. Wade. He is against embryonic stem cell research even though the people of California voted for it. And on and on and on. James Dobson just doesn't give two hoots about "a government of the people" he wants a government of the James Dobsons and Chuck Colsons of the world.
I am completely baffled by Dobson 's reference to the Gettysburg address. In the context of this issue, it is completely irrelevant.
If the Court has "usurped the other two branches of government," it has done it from the right not the left. As John in DC said on AMERICABlog,
7 of the 9 justices on the US Supreme Court are Republican appointees. That means 7 Republicans to 2 Democrats. Hello? That means greater than a 3 to 1 majority of Republicans. How in God's name in that a liberal or even moderate court.
Anytime someone says I'm not trying to "sway anybody," on such a call is simply lying. Why bother to join the call and put in your two cents if you are not trying sway somebody?
I want to look at one other comment that fell from Dobson's lips, "power itself tends to corrupt." I actually think this is true. If those that currently run our country were not corrupt when they took office, power has certainly corrupted them. But Dobson is talking abut the Justices of Supreme Court of these United States. Exactly what has corrupted them? Their daily contacts with lobbyists? Their desire to enrich their friends at the Country's expense? Their lust for war? No, none of these things. What tends to "corrupt" Supreme Court Justices is the Constitution and the long tradition of legal precedents that further define it. Sure, they also bring to the Court their long standing judicial and political views but that just brings us back to the simple fact stated above, "7 of the 9 justices on the US Supreme Court are Republican appointees."
