Torture: Army Tries to End Run McCain Legislation

The Army has sent up for final approval a new classified amendment on torture to its field manual.

Here's the problem,

"Mr. McCain's measure, which the Senate has overwhelmingly approved, would require that only interrogation techniques authorized by the new Army field manual be used on prisoners held by the military. [NYT]"

And as the New York Times says,

The addendum provides dozens of examples and goes into exacting detail on what procedures may or may not be used, and in what circumstances. Army interrogators have never had a set of such specific guidelines that would help teach them how to walk right up to the line between legal and illegal interrogations. [emphasis added]

Interrogators, Army, CIA and others, need guidelines on how to stay away from that "line" not how to approach it as a limit. What we need is a legally binding commitment from our government that they will stay away from this "line." There can be little doubt that these new guidelines were intended to frustrate the negotiations now going on between the Senate, the Administration and House of Representatives. As Atrios says,

It's a fetish, really, there's no other explanation.
